1. HOW TO ENTER: Drivers officially winning an A-Main Feature Race in either the Sprint, Late Model, Big Block Modified and UMP Modified car divisions during the Alltel DIRTcar Nationals being held February 3rd – 18th, 2009 will be eligible to become one of the up to 24 featured drivers in the Driver Trade Promotion who will have the chance to win either a $10,000 cash award or one of three $1,000 cash awards from Alltel Wireless and World Racing Group ($10,000 winner being the driver who receives the most online votes and $1,000 winners being the three drivers that receive the most votes in their respective car division, excluding the $10,000 winner and respective division), provided he or she agrees to the appropriate waiver. Voting may be accomplished via www.alltelallstar.com as follows: HOW TO VOTE AND ENTER THE VOTING SWEEPSTAKES VIA ONLINE: Beginning 9:00 am ET on 2/4/2009 through 11:59 p.m. ET on 2/28/2009, when you register on www.alltelallstar.com (the “Web Site”) and vote for your favorite driver (from the provided list of drivers), you will automatically be entered into the Consumer Sweepstakes. Limit one vote/entry per email address per day. Entries must be received by 11:59 p.m. ET on 2/28/2009. Online entries will be subject to standard Internet access and usage charges imposed by your Internet service provider. HOW TO VOTE AND ENTER THE VOTING SWEEPSTAKES VIA TEXT MESSAGING: Beginning 9:00 am ET on 2/4/2009 through 11:59pm ET on 2/28/09, when you text your vote for your favorite driver (from the provided list of drivers) you will automatically be entered into the Consumer Sweepstakes. Limit one vote/entry per phone number per day. You may text your vote if you have a text messaging capable cell phone from any wireless carrier with the appropriate short-code capabilities, you may send a text message to the short code 247253 with the letter that corresponds to the driver you wish to vote for from the list of specified drivers. Entries must be received by 11:59 p.m. ET on 2/28/2009. Standard text messaging rates apply to each text message sent or received as provided in your wireless rate plan. (Contact your carrier for pricing plans and details.) Certain prepaid customers may not be able to enter via text message.
2. ELIGIBILITY: The Driver Trade Promotion is open to all drivers competing in the event, provided that they agree to the appropriate waiver. The Consumer Sweepstakes is open only to legal residents of the 50 United States and DC who are 18 years of age or older as of date of entry. Employees of Alltel Communications, LLC (“Alltel”), World Racing Group, GMR Marketing LLC (“GMR”), their subsidiaries, divisions, affiliates and related companies, advertising and promotion agencies, and their immediate families of each are ineligible. Void where prohibited by law. All United States federal, state, and local laws and regulations apply.
3. RANDOM DRAWING: One Grand Prize Consumer Sweepstakes winner will be selected in a random drawing to be conducted on or about 3/4/2009 from among all eligible consumer entries received. Drawing will be conducted by World Racing Group, Inc. whose decisions are final on all matters relating to this Promotion. Grand Prize winner will be notified by phone/mail by GMR on or about 3/5/09. Return of prize/prize notification as undeliverable may result in disqualification and alternate selection. Acceptance of prize by Consumer winner constitutes winner’s consent that his/her name, likeness, voice, and/or biographical data may be used for advertising and promotional purposes without limitation and without additional notice, compensation, or consent by Alltel, World Racing Group, GMR, and each of their respective parents, subsidiaries, affiliates, directors, owners, employees and agents except where prohibited by law. Odds of winning depend upon the total number of eligible entries received.
4. CONSUMER PRIZE: (1) Grand Prize – A $500 Alltel Wireless gift card. Prize is not transferable by winner and no prize substitution or cash alternatives are allowed except by Alltel due to unavailability of prize. Alltel reserves the right to substitute prize of the same approximate retail value. Prize consists only of the item specifically listed as the prize. Certain conditions and restrictions apply.
5. DRIVER TRADE PROMOTION: Eligible drivers may encourage consumers to vote by promoting www.alltelallstar.com through all promotional avenues available to them, provided that no attempts to damage the website, voting process or to develop any automated voting system are made or endorsed. Administrator reserves to right to disqualify any driver found to be participating in or cooperating with any such activity.
6. DRIVER AWARDS: A cash award of $10,000 will be paid by Alltel Wireless to the driver receiving the highest total number of votes during the designated voting period. A cash award $1,000 will be paid by Alltel Wireless to the drivers receiving the most votes of any driver in their respective division, excluding the $10,000 winner (i.e. If a Late Model driver receives the highest overall vote total and thus receives the $10,000 cash award, the $1,000 cash awards would go to the Sprint driver, Big Block Modified driver and UMP Modified driver who receive the most votes of any driver in their respective divisions, regardless of their ranking in the overall vote totals. Awards are not transferable by winners and no prize substitution or cash alternatives are allowed. Odds of winning depend upon the total number of eligible drivers.
7. DRIVER AWARD WINNERS: Potential winners will be named Driver Award winners only upon verification of identity and eligibility to Sponsor’s satisfaction. Driver Award winners will be formally notified by phone/mail by GMR on or about 3/4/09. Driver Award winners may be required to complete, sign and return an Affidavit of Eligibility, Publicity Release, Mutually-Agreeable Liability Release and any required tax documents. If the Affidavit of Eligibility, Publicity Release, Mutually-Agreeable Liability Release and any required tax documents are not returned within seven (7) calendar days after notice is sent or if returned as undeliverable, the prize may be forfeited in its entirety and an alternate winner may be selected. Driver Award winners are individually responsible for all federal, state, and local income taxes and other taxes associated with the prize. Alltel will comply with all tax reporting requirements. Awards will be fulfilled approximately 4-6 weeks after the winner is confirmed. Acceptance of Awards by Driver Award winners constitute winner’s consent that his/her name, likeness, voice, and/or biographical data may be used for advertising and promotional purposes without limitation and without additional notice, compensation, or consent by Alltel, World Racing Group, GMR, and each of their respective parents, subsidiaries, affiliates, directors, owners, employees and agents except where prohibited by law.
8. GENERAL RULES: By entering, consumer entrant agrees to accept and abide by the rules of this sweepstakes and agrees that any dispute in regard to the conduct of this sweepstakes, rule interpretation, or award of prize shall be submitted to Administrator, whose decisions shall be binding and final. Unless otherwise prohibited by law, submission of entries constitutes permission to use the entrant’s name, likeness and biographical information for advertising and publicity purposes, without further compensation. All entries will be declared made by the authorized account holder of the e-mail address/cellular phone submitted at the time of entry. "Authorized account holder" of an email address is defined as the natural person who is assigned to an e-mail address by an Internet Access provider, on‑line service provider, or other organization (e.g., business, educational institution etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. “Authorized account holder” of a cellular phone is the natural person in whose name the phone has been issued and to whom services are billed. Administrator reserves the right, in its sole discretion, to modify, terminate, or suspend the sweepstakes should viruses, bugs, unauthorized human intervention, or causes beyond Administrator’s control, corrupt, or impair the administration, security, or fairness of the sweepstakes and award the prize from the eligible entries received prior to termination. Administrator reserves the right, in its sole discretion, to disqualify any individual found to be tampering with the entry process or the operation of the Sweepstakes, acting in violation of these rules, acting in an unsportsmanlike or disruptive manner, or acting with intent to annoy, abuse, threaten, or harass any other person. Any use of robotic, automatic, programmed, or similar entry methods will void all entries submitted by such methods. CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR/ADMINISTRATOR RESERVE THE RIGHT TO PROSECUTE AND SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW. Sponsor/Administrator and their agencies are not responsible for technical, hardware or software malfunctions, telephone failures of any kind, lost or unavailable network connections, or failed, incorrect, inaccurate, incomplete, garbled or delayed electronic communications whether caused by the sender or by any of the equipment or programming associated with or utilized in this sweepstakes which may limit the ability to participate or by any human error which may occur in the processing of the submissions in this sweepstakes. Entrants agree to be bound by these Official Rules and the decisions of the Administrator/judges, which are final and binding. By participating in the Sweepstakes, entrant agrees to hold harmless Alltel, World Racing Group, GMR, and their respective parent companies, affiliates, subsidiaries, service agencies, independent contractors, and the officers, directors employees, agents, and representatives of the above organizations from any injury, loss, or damage to person including death or property, due in-whole or in-part, directly or indirectly, to the acceptance or use/misuse of prize, participation in any sweepstakes-related activity or participation in the sweepstakes. As a condition of entering the sweepstakes, participant agrees that: 1) under no circumstance will participant be permitted to obtain awards for, and participant hereby waives all rights to claim punitive, incidental, consequential or any other damages, other than for out-of-pocket expenses; 2) all causes of action arising out of or connected with this sweepstakes, or prize awarded, shall be resolved individually, without resort to any form of class action; and 3) any and all claims, judgments, and award shall be limited to actual out-of-pocket costs incurred, but in no event attorney’s fees. Alltel is not responsible for any typographical or other error in the printing of this offer, administration of the sweepstakes or in the announcement of prize. By entering this sweepstakes, you agree you are giving Alltel and World Racing Group permission to contact you via email, mail or telephone regarding marketing, advertising, promotions or other special offers, despite any inclusion of your name on a “do not call” contact registry or list.
9. WINNERS: Winner’s names will be posted at www.alltelallstar.com after 3/15/2009.
